Terms of Use
Last updated: 24 October 2026
What changed: Oathset is for people 18 or older; nothing is sold on the website, and the Founder's seat is sold only in the app; invites move you up the waitlist; fair play checks hide an account from others and never take rewards; what a Founder's seat includes; a Google Play section; the beta terms linked.
These terms are an agreement between you and Sobosoftware Ltd. ("we", "us"), a company registered in New Zealand, about your use of the Oathset app and related services, including the waitlist and the beta ("Oathset"). By joining the waitlist, creating an account or using Oathset, you agree to them. Please also read our Privacy Policy.
1. Who can use Oathset
You must be 18 or older to use Oathset, including the waitlist and the beta.
2. Your account
- Give accurate information and keep your sign-in details safe. You're responsible for what happens on your account.
- One account per person. Accounts are personal and can't be sold or transferred.
- Usernames and guild names must not be offensive, impersonate anyone, or infringe anyone's rights. We may change or remove ones that do.
- You can delete your account at any time (Settings → Delete account, or on the web).
3. Your health comes first
Oathset is a game that rewards training. It is not medical, fitness or nutritional advice, and it doesn't assess whether any exercise is safe for you. Talk to a doctor before starting a new exercise programme, especially if you have a medical condition or injury. Train within your limits and stop if you feel pain, dizziness or discomfort. You are responsible for how and how hard you train.
4. Free play and membership
Free play
Oathset is free until your character reaches level 10. To keep playing after that, you need a membership. Your character and progress are kept either way. Free play isn't a store trial: nothing is charged when it ends.
Plans
- Monthly and yearly subscriptions renew automatically at the end of each period, at the price shown in the store, until you cancel.
- The Founder's seat is a one-time purchase in the app, offered for a limited time. There is one worldwide limit of 500 seats, and the app shows how many are left. If your purchase completes after the last seat has gone, we still honour it. A seat includes lifetime membership, the Founder's cape, the Founder's Eyes, and your seat number and Founder title beside your name. Its membership is "lifetime": for as long as we operate Oathset, not for any particular length of time. A seat is personal to your account and can't be transferred.
Payment, cancelling and refunds
- Purchases are made and charged through Google Play or the Apple App Store, under their terms. We never see your payment details. Nothing is sold on our website.
- You can cancel a subscription at any time in your Google Play or App Store subscription settings. Cancel at least 24 hours before it renews to avoid the next charge. You keep membership until the end of the period you've paid for.
- Deleting your account or the app does not cancel a subscription. Cancel it in the store.
- Google and Apple process refunds for purchases made through them, under their refund policies. That doesn't limit your rights under consumer law (see section 10): if something is wrong with your membership, you can also contact us.
- If we change subscription prices, the store will tell you in advance, and you can cancel before the new price applies.
- If you're a consumer in the EU or UK: by starting a membership you ask us to give you access straight away, and you acknowledge that you lose your right to withdraw from the purchase once access begins.
What membership includes
Membership unlocks playing Oathset beyond level 10. We keep improving the game, so features will change over time. We may also offer optional extras, such as cosmetic items or special events, which may be sold separately.
5. In-game items and currencies
Coins, Marks, resources, items and other in-game things have no real-world value. They can't be exchanged for money, sold or transferred outside the game, and you don't own them: we give you a personal, revocable licence to use them in Oathset. We may change, rebalance or remove them as we develop the game. This includes waitlist rewards.
6. Fair play
You agree not to:
- log workouts you didn't do, or otherwise farm rewards dishonestly;
- use bots, scripts, modified apps or unofficial tools, or exploit bugs;
- attack, overload, reverse engineer or interfere with Oathset or its servers, except as the law allows;
- harass, threaten or abuse other players, or use Oathset for anything unlawful.
We automatically check for implausible activity. An account that logs more than even elite athletes train is under review for 28 days: players outside its guild can't see or find it, and its guildmates see it marked "under review". It never loses rewards. Our Privacy Policy explains these checks. If we reasonably believe you've seriously or repeatedly broken these rules, we may suspend or close your account (section 9). Where we can, we'll tell you why, and you can ask us to review it.
7. Our content
Oathset, including its software, art, text and game design, belongs to us or our licensors. We give you a personal, non-exclusive, non-transferable licence to use the app on devices you own or control, for your own non-commercial use, under these terms. If you send us feedback or ideas, we may use them without owing you anything.
8. Changes and availability
We may update Oathset, and change or end features, at any time. We'll try to keep it running smoothly but can't promise it will always be available or error-free. If we ever shut Oathset down, we'll give you reasonable notice in the app. We may change these terms; if a change is significant, we'll tell you before it takes effect. If you keep using Oathset after that, you accept the new terms.
9. Ending your use
You can stop using Oathset and delete your account at any time. We may suspend or close your account if you seriously or repeatedly break these terms, or if the law requires it. Sections 5, 7, 10 and 11 continue to apply after your account ends.
10. Liability
Oathset comes with guarantees that can't be excluded under the New Zealand Consumer Guarantees Act 1993 and the Australian Consumer Law. For example, if a membership you've paid for has a major failure, you may be entitled to a refund. Nothing in these terms excludes, restricts or changes those guarantees or your remedies under them, or any other rights you have under consumer laws that can't be excluded, including those of the EU and UK. If you're a consumer in the UK, that includes your remedies under the Consumer Rights Act 2015 if digital content you've paid for is faulty. If you're using Oathset for the purposes of a business, the Consumer Guarantees Act doesn't apply.
Apart from those rights, and only to the extent the law allows:
- we don't make any promises about Oathset other than those in these terms;
- we aren't liable for indirect or consequential loss;
- we aren't liable for injury from exercise you choose to do, unless our own negligence caused it; and
- our total liability to you for any claim is limited to the amount you paid for Oathset in the 12 months before the claim arose, or NZ$100, whichever is greater.
11. Governing law
These terms are governed by the laws of New Zealand, and the New Zealand courts can hear disputes about them. If you're a consumer living elsewhere, you also keep the protection of the mandatory laws of your country, and can bring proceedings there.
12. App stores
If you downloaded Oathset from the App Store
- These terms are between you and us, not Apple. Apple is not responsible for Oathset or its content.
- Apple has no obligation to provide maintenance or support for Oathset.
- If Oathset fails to meet any applicable warranty, you can tell Apple, and Apple will refund the purchase price (if any). To the extent the law allows, Apple has no other warranty obligation for Oathset.
- Apple is not responsible for any claims relating to Oathset, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection claims.
- If anyone claims that Oathset infringes their intellectual property, we, not Apple, are responsible for dealing with it.
- You confirm that you're not in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you're not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you.
If you downloaded Oathset from Google Play
- Google Play's terms of service apply to your use of Google Play, alongside these terms.
- These terms are between you and us, not Google. Google isn't responsible for Oathset or its support.
- Refunds for purchases made through Google Play follow Google Play's refund policy, as section 4 says.
13. The waitlist and its rewards
- Joining the waitlist is free. Join once, with your own email address. You must be 18 or older (section 1).
- When you confirm your email, you get an invite link. Each person who joins the waitlist with it and confirms their email counts as one invite.
- Invites move you up the waitlist. The closed beta opens in waves from the waitlist, in order. Invites never buy or earn access to Oathset or the beta: the beta is free, and the beta terms explain how it works.
- Invites also earn these rewards:
- 1 invite: you and each friend who joins with your link start Oathset as friends.
- 3 invites: the Founder's Eyes, a look for your hero.
- 10 invites: two months of membership, free, starting when free play ends at level 10.
- 25 invites: a Founder's seat, free, for the first 50 people to get there.
- A Founder's seat earned with invites is the same as one bought in the app (section 4), given free, and is one of the 500. Rewards for the first few people to reach them go in the order in which each person's last needed invite was confirmed.
- Only genuine invites count. Don't sign up email addresses that aren't yours or without their owner's permission, use fake or disposable addresses, sign up automatically, or spam your link. We may not count invites, or may remove someone from the waitlist, if we reasonably believe this has happened.
- Waitlist rewards are in-game items, looks, membership time or a Founder's seat, and section 5 applies to the items and looks. None gives an advantage in play. They go to the Oathset account you create with the same email address as your waitlist sign-up, within 6 months of Oathset's release.
- We may change or end the waitlist's rewards, but we'll still give you rewards you've already earned.
- Nothing is sold on the waitlist or anywhere else on our website.
- You can leave the waitlist at any time by unsubscribing from its emails. Our Privacy Policy explains how we handle your waitlist information.
